Only witches and wizards with great understanding of and skill in magic were known to be able to invent spells. It is unknown what the exact process was to creating spells other than crafting the wand movement and the incantation. What is known is that it was a very difficult, even dangerous process. If something went wrong, the results could prove fatal; an example of this was Pandora Lovegood's experimentation.
Not much is known about this form of magic. Most wizards and witches only know it is extremely dangerous and that a lot of people have suffered a great deal of injures and even death, hence few attempt it.

It seems centered very much around Latin. About 90% of all the spells are Latin in different forms; presumably, in order to create spells, it is very important to find the correct Latin pronunciation (as seen in Snape's potion book, wherein line after line had been crossed out, apparently as a result of trial-and-error.)

Possible spell inventions
*It is possible that Gilderoy Lockhart was a spell inventor, as he seemed to make several spells (Deboning, Peskipiksi Pesternomi, etc.) up on the spot. This would explain why he did not expect them to work the way they did all of them producing the correct effect (etymologically speaking) bar Peskipiksi Pesternomi.

*It is possible that Antonin Dolohov invented his signature curse as he is the only Death Eater shown using it and demonstrated a certain sadistic pride when he successfully cast it against Hermione during the Battle of the Department of Mysteries.
  +
*Lord Voldemort likely invented some of the protective spells he used in the hiding places of his Horcruxes, such as the Gaunt Shack and the Horcrux Cave. These spells were extremely dark in nature and extremely difficult for even Albus Dumbledore to penetrate sometimes requiring the aid of another wizard. Similarly, Dumbledore needed the aid of another wizard who was especially talented in healing and quarantining from injuries caused by one of Voldemort's curses.
  +
*It is possible that Hermione Granger invented the Four-Point Spell, as she particularly searched it for Harry Potter (who is the only person who used it) and the incantation is English.
  +
**It is also possible that she invented the Dumbledore's Army parchment jinx, given the apparent lack of a counter-jinx or cure apart from the boils fading on their own, as well as being specifically stated to identify traitors from the army.

"She was a quite extraordinary witch, you know, but she did like to experiment and one of her spells went rather badly wrong one day."
Luna Lovegood regarding her mother's tragic death[src]

The art of creating new spells was both highly dangerous and complex.

Nature

Only witches and wizards with great understanding of and skill in magic were known to be able to invent spells. It is unknown what the exact process was to creating spells other than crafting the wand movement and the incantation. What is known is that it was a very difficult, even dangerous process. If something went wrong, the results could prove fatal; an example of this was Pandora Lovegood's experimentation.[1]
